Garage conversion ADUs in Berkeley, CA

A conversion reuses a structure you already have. The city treats it differently from a new building, and a licensed contractor still has to scope and price it.

What the city says about conversions

The city defines a conversion ADU as one made by converting an existing accessory building or structure, or non-livable interior space such as a garage or workshop. Its information sheet says the converted structure may keep its current size and location and any existing nonconformities, provided it meets fire and safety requirements. A conversion that exceeds the usual maximum size is allowed if it makes no changes to the building envelope.

New windows, doors or other openings in a lawful nonconforming structure can be added with a Zoning Certificate. Excavating inside a required setback first needs an Administrative Use Permit. When a garage or covered parking space is replaced by an ADU, an uncovered replacement space is allowed, in any configuration including the front setback, but parking is not required.

Conversion questions

Do I have to replace the parking?

No. The city says parking is not required for ADUs. If you choose to provide replacement parking, an uncovered space is allowed by right.

Can I convert a garage next to an old unpermitted unit?

The city has an amnesty program for existing unpermitted ADUs. Ask the contractor we connect you with whether your unit qualifies.
